These Terms of Use ("Terms") govern your access to and use of the CBD website and app — accounts, rosters, scheduling, payments, video, and messaging (collectively, the "Service"), operated by Triple Impact Coaching, doing business as CBD ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
These Terms govern the software platform itself. Participating in physical program activities (camps, clinics, practices, games, and other training) is separately governed by the liability waiver and media release you sign before a child participates — that document, not these Terms, covers the risks of athletic participation.
A parent or legal guardian creates and controls the account for any athlete under 18, including any athlete under 13 — an athlete under 13 never has their own login. An athlete 13 or older may have their own limited account, used with the involvement of their parent or guardian.
A coach or admin account requires you to be at least 18 and legally able to enter into this agreement.
You agree to provide accurate account information, keep your password confidential, use only your own account, and tell us promptly at arvin@coachbydesign.com if you believe your account was accessed without permission. We may suspend access when reasonably necessary to investigate suspected fraud, security threats, payment disputes, or a violation of these Terms.
Pricing for a specific program (camp, clinic, private training, group workout) or video/skill-module purchase or subscription is shown at checkout. Payments are processed by Stripe; we do not directly receive or store your complete card number. You authorize Stripe to charge the displayed price and any clearly disclosed tax.
A program may have a registration capacity and, where enabled, a waitlist. Being waitlisted does not guarantee a spot; you'll be notified if one opens up.
To request a refund or cancellation, contact us at arvin@coachbydesign.com with your registration details. Refund requests are reviewed individually and, once approved, are processed back to the original payment method — processing time depends partly on the payment provider and your financial institution.
A specific program's coach or admin may set a different cancellation window or policy for that program (for example, a cutoff before a camp date); check the program's listing or ask before registering. Nothing in this section limits a right that cannot lawfully be waived.
Enrollment or an account gives you a limited, personal, nonexclusive, nontransferable, revocable right to use the Service for its intended purpose — registering for and managing participation in programs, viewing skill content, and communicating with your coach/organization.
We may improve, correct, reorganize, or retire features. We don't guarantee uninterrupted access — maintenance, a service-provider interruption, or circumstances outside our reasonable control may temporarily affect availability.
A coach may upload a video file or link a YouTube video to the skill library or a team's page. A coach linking a YouTube video represents that they have the right to share it in this way (for example, that it's their own content, even if kept private or unlisted on YouTube).
A video may be marked required viewing by a coach or admin; the Service records when an athlete has watched it so a coach can follow up. We don't guarantee a required video will play correctly on every device or network.
Submitted video and other content remains yours; you grant us a limited, nonexclusive license to host, store, and display it as reasonably necessary to operate the Service, and represent that you have the right to submit it.
The Service includes in-app direct messaging and one-way broadcasts from a coach/admin to a roster. Opting in to SMS or push notifications is optional and can be withdrawn at any time (see the Privacy Policy). Don't use the Service's messaging to harass, spam, or contact anyone outside its intended coach/family use.
You may not: use the Service unlawfully or fraudulently; access another user's account or restricted administrative functions; probe or test the Service for vulnerabilities without written authorization; introduce malware; disrupt the Service; circumvent payment, access, or approval controls; upload video content you don't have the right to share; or use the Service in a way that infringes or harms another person's rights.
The Service — including its design, software, and platform features — is owned by or licensed to us and protected by applicable law. You may not reproduce, resell, sublicense, reverse-engineer, or systematically scrape it, except where such a restriction is prohibited by law.
The Service relies on third-party providers, which may include Stripe, Supabase, Vercel, Twilio, an email provider, a push-notification provider, and YouTube (for an embedded video). Their services are governed by their own terms and privacy practices; we're not responsible for a third-party service outside our reasonable control, but remain responsible for our own obligations concerning the providers we select and the information we give them.
To the fullest extent permitted by law, the Service is provided "as is" and "as available." We do not guarantee specific athletic, coaching, or program outcomes, that every error will be corrected, or that the Service will always be uninterrupted or compatible with every device. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.
To the fullest extent permitted by law, Triple Impact Coaching and its owners, employees, coaches, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, opportunity, goodwill, or data arising from the Service.
To the fullest extent permitted by law, our total liability arising from the Service will not exceed the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or US $100. This limitation doesn't apply where prohibited by law, and doesn't limit liability that can't legally be limited — for example, liability arising from participation in physical program activities is governed separately by the liability waiver you sign, not by this section.
To the extent permitted by law, you agree to indemnify and hold Triple Impact Coaching harmless from a third-party claim resulting from your unlawful use of the Service, your infringement of another person's rights, or content you submit in violation of these Terms. This doesn't require you to indemnify us for our own negligence, misconduct, or violation of law.
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Before filing a formal claim, you and Triple Impact Coaching agree to make a good-faith effort to resolve the matter by written notice to arvin@coachbydesign.com and allowing 30 days for a response. A legal proceeding not resolved informally will be brought in the state or federal courts with jurisdiction over Triple Impact Coaching's home location in Washington, unless applicable consumer law gives you the right to proceed elsewhere. Nothing here prevents either party from using small-claims court or seeking urgent relief to protect intellectual-property, privacy, or security rights.
We may update these Terms as the Service, law, or our business practices change. We'll post the updated Terms with a revised effective date, and give additional notice where a change materially affects existing users. Changes apply prospectively unless law permits otherwise.
If one provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision isn't a waiver. You may not transfer these Terms without our permission; we may transfer them as part of a merger, reorganization, or sale of the business. These Terms, the Privacy Policy, the separate liability waiver, and any policy expressly incorporated form the agreement between you and Triple Impact Coaching concerning the Service.
